What This Means (2025 FDD)
According to the 2025 Black Bear Diner Franchise Disclosure Document, the franchise agreement has an initial term that begins when you sign the agreement and expires 10 years from the date you actually open your Black Bear Diner restaurant. However, this is subject to earlier termination for cause in accordance with the terms of the Franchise Agreement.
To renew your Black Bear Diner franchise for an additional 10-year term, you must meet several requirements. You must have substantially complied with all the provisions of the Franchise Agreement and not be in default at the time of renewal. You need to maintain possession of the premises where you operate your Black Bear Diner restaurant. Additionally, you'll be required to make expenditures to remodel, modernize, and redecorate the restaurant to reflect the current appearance of new Black Bear Diner locations.
Further renewal requirements include providing notice of your intent to renew, signing a new franchise agreement, and meeting the current training requirements. You will also need to pay a renewal fee of $5,000 and sign a general release. It is important to note that the terms of the new franchise agreement may contain materially different terms and conditions than the original agreement.
