Is the franchisee required to strictly comply with the standards and specifications established by Black Bear Diner?

Franchisee acknowledges that its right to use the Marks is derived solely from this Agreement and is limited to the conduct of business by Franchisee pursuant to and in compliance with this Agreement and all applicable standards, specifications and operating procedures prescribed by Franchisor during the term of the Franchise.
Franchisee agrees to maintain its Franchised Restaurant consistent with its own high standards as well as with Franchisor's standards as set forth in the Manual.
Franchisee agrees that Franchisor, Franchisee and other Black Bear Diner franchisees will benefit from the maintenance of reasonable standards for appearance and trade dress including prominent display of the Marks and the distinctive black bear trade dress. The Approved Location and the Franchised Restaurant will conform to all specifications for decor, furniture, fixtures, equipment, exterior and interior decorating designs and color schemes established by the Franchisor.
Franchisor may, from time to time, at its discretion, cause its representatives to visit Franchisee's Black Bear Diner restaurant for the purpose of rendering advice and consultation or training, with respect to the Franchised Restaurant, its operation and performance, and compliance by Franchisee with the Manuals including the right to remove samples of food or non-food items from the Franchised Restaurant, without payment therefor, in amounts reasonably necessary for testing by Franchisor's representatives to determine whether such samples meet Franchisor's then current standards and specifications.
Franchisee acknowledges that because complete and detailed uniformity under many varying conditions may not be possible or practical, Franchisor specifically reserves the right and privilege, at its sole discretion and as it may deem in the best interests of all concerned in any specific instance, to vary standards for any franchisee based upon the peculiarities of any particular site or other circumstances, density of population, business potential, existing business practices or any other condition which Franchisor deems to be of importance to the operation of any particular Black Bear Diner restaurant. Franchisee agrees that it shall have no claim against Franchisor on account of any variation from System standards granted to any franchisee and shall not be entitled to require Franchisor to disclose or grant to Franchisee a like or similar variation hereunder.

While franchisees must generally comply with Black Bear Diner's standards, Black Bear Diner reserves the right to vary these standards at its discretion based on specific site conditions or other factors, without granting franchisees the right to demand similar variations.
