What This Means (2025 FDD)
According to Bigfoot Forestry's 2025 Franchise Disclosure Document, if Bigfoot Forestry offers you a franchise, it must provide the Disclosure Document to you 14 days before you sign a binding agreement or make a payment with the franchisor or an affiliate in connection with the proposed franchise sale. New York requires that Bigfoot Forestry give you this Disclosure Document at the earlier of the first personal meeting or 10 business days before the execution of the franchise or other agreement or the payment of any consideration that relates to the franchise relationship.
Attachment "E" to the Franchise Agreement is a Confidentiality Agreement. The Confidentiality Agreement is entered into by the undersigned ("you") in favor of Bigfoot Franchising, LLC, a South Carolina limited liability company, and its successors and assigns ("us").
Given that the Confidentiality Agreement is included as an attachment to the Franchise Agreement, it is highly likely that signing the Non-Disclosure Agreement would be considered 'any agreement relating to the franchise.' Therefore, the 14-day review period would apply before signing the Non-Disclosure Agreement. A prospective franchisee should carefully review all documents and seek legal counsel to ensure full compliance with disclosure requirements.
