What This Means (2025 FDD)
According to Bigfoot Forestry's 2025 Franchise Disclosure Document, Bigfoot Franchising, LLC retains ownership of all operational and customer data related to a franchisee's Bigfoot Forestry Business. This includes data collected during the franchisee's operations and interactions with customers. However, the franchisee is granted a license to use this data during the term of their Franchise Agreement.
This arrangement means that while franchisees can utilize the operational and customer data to manage and grow their business, they do not have ultimate ownership or control over it. Bigfoot Forestry maintains the right to use this data for its own purposes, such as analyzing system-wide performance, refining marketing strategies, or developing new services.
As a franchisee, you are obligated to treat this data as confidential and proprietary, adhering to all applicable data protection laws and the franchisor's data processing and privacy policies outlined in the manual. This includes safeguarding the data from unauthorized access or disclosure and using it only for purposes aligned with the Franchise Agreement. Franchisees must also promptly inform Bigfoot Forestry of any unauthorized use of their proprietary information or copyrighted materials.
This data ownership structure is fairly common in franchising, allowing the franchisor to maintain consistency and control across the brand while still enabling franchisees to leverage data for local business development. Prospective franchisees should carefully review the data usage policies in the manual and franchise agreement to fully understand their rights and obligations regarding customer and operational data.
