What This Means (2025 FDD)
According to the 2025 Bigfoot Forestry Franchise Disclosure Document, it is essential to carefully read the Disclosure Document and all agreements. The document explicitly states that it summarizes certain provisions of the franchise agreement and other information in plain language, emphasizing the importance of a thorough review.
Bigfoot Forestry requires that franchisees complete a questionnaire to confirm they had adequate opportunity to review the Franchise Disclosure Document and its attachments, consult with advisors, and ask questions about any disclosures or terms they don't understand. This questionnaire is a measure to ensure that the franchise sales team followed proper procedures and that the franchisee is well-informed before signing the Franchise Agreement. However, this questionnaire cannot be signed or dated on the same day as the receipt for the Franchise Disclosure Document, but it must be signed and dated on the same day the Franchise Agreement is signed and the franchise fee is paid.
Furthermore, Bigfoot Forestry must provide the Disclosure Document to prospective franchisees at least 14 days before they sign a binding agreement or make any payment to the franchisor or its affiliates. In New York, this period is the earlier of the first personal meeting or 10 business days before signing any agreement or paying any consideration related to the franchise. Failure to deliver the Disclosure Document on time or if it contains false or misleading statements or material omissions, may constitute a violation of federal and state laws, which should be reported to the Federal Trade Commission and the appropriate state agency.
