What This Means (2025 FDD)

According to the 2025 Bigfoot Forestry FDD, Bigfoot Forestry retains ownership of all operational and customer data related to a franchisee's Bigfoot Forestry Business. However, Bigfoot Forestry does grant the franchisee a license to use this data during the term of the Franchise Agreement. This means that while the franchisee can utilize the data to operate and grow their business, they do not own the data outright.

The FDD emphasizes that franchisees must treat this data as confidential and proprietary, and they must comply with all applicable data protection laws and Bigfoot Forestry's data processing and data privacy policies as outlined in the Manual. This highlights the importance of data security and privacy for franchisees.

This arrangement is fairly common in franchising, where the franchisor wants to maintain control over important business data while still allowing franchisees to use it for their local operations. Prospective franchisees should carefully review the data protection laws and Bigfoot Forestry's data processing and privacy policies to understand their obligations and limitations regarding the use of this data.
