What This Means (2025 FDD)
According to Bigfoot Forestry's 2025 Franchise Disclosure Document, franchisees must adhere to specific brand protection covenants concerning intellectual property. Upon termination, expiration, or transfer of the franchise agreement, franchisees must immediately cease using Bigfoot Forestry's Intellectual Property and Confidential Information. This includes refraining from any use of the Intellectual Property or Confidential Information beyond the scope of operating the Bigfoot Forestry Business as outlined in the Franchise Agreement and Manual. Franchisees are also obligated to maintain the confidentiality of the Confidential Information at all times and prevent any unauthorized copies or disclosure of such information.
Bigfoot Forestry requires franchisees to take all reasonably necessary steps to prevent unauthorized use or disclosure of Confidential Information. Additionally, franchisees must provide satisfactory evidence of their compliance with these obligations within 30 days after the effective date of the termination, expiration, or transfer of the Franchise Agreement.
These requirements ensure that Bigfoot Forestry's proprietary information and brand identity are protected even after a franchise ceases operation or changes ownership. This is a standard practice in franchising to maintain brand consistency and prevent misuse of intellectual property. Failure to comply with these covenants could result in legal action from Bigfoot Forestry to protect its brand and trade secrets.
