Can a Bigfoot Forestry franchisee use the Marks in a modified form?

According to the 2025 Bigfoot Forestry FDD, franchisees are explicitly prohibited from using the Marks in any modified form. The Marks include all service marks, trademarks, trade names, and logos that Bigfoot Forestry designates for use by its franchisees, including BIGFOOT FORESTRY® and associated logos. This also extends to any distinctive trade dress used to identify a Bigfoot Forestry Business.

Specifically, franchisees cannot use the Marks as part of a corporate or trade name, or with any prefix, suffix, or other modifying words, designs, or symbols, except for logos that Bigfoot Forestry licenses to them. This restriction ensures that the brand's identity remains consistent and uniform across all franchise locations, preventing any potential confusion among customers.

Furthermore, franchisees are not allowed to use the Marks when signing contracts, leases, checks, or any other agreements in a manner that could imply that Bigfoot Forestry is liable for the franchisee's obligations. They are also barred from registering or attempting to register any Mark, or a trademark that is confusingly similar to a Mark, with any Governmental Authority. Lastly, franchisees cannot challenge or contest the validity or ownership of Bigfoot Forestry's Marks. These measures are in place to protect Bigfoot Forestry's intellectual property and maintain the integrity of the brand.
