Where can I find the Bigfoot Forestry Area Development Agreement?

If you satisfy our criteria for multi-unit developers, we may (but need not) offer you the right to sign the form of Area Development Agreement attached to this Disclosure Document as EXHIBIT "D" (the "ADA"). The ADA grants you the right and obligation to develop, open and operate multiple Bigfoot Forestry Businesses within a defined "development territory" according to a predetermined "development schedule". Each franchised territory is considered a separate Bigfoot Forestry Business. You must develop, open and operate all of the Bigfoot Forestry Businesses listed in the development schedule. We only grant area development rights to franchisees who commit to develop, open and operate a minimum of 3 Bigfoot Forestry Businesses. You must sign a separate franchise agreement for each Bigfoot Forestry Business you develop. Each franchise agreement will be our then-current form of franchise agreement, which may differ from the current form of Franchise Agreement attached to this Disclosure Document.

What This Means (2025 FDD)
According to Bigfoot Forestry's 2025 Franchise Disclosure Document, the form of the Area Development Agreement (ADA) that you may sign if you meet the criteria for multi-unit developers is attached to the Disclosure Document as EXHIBIT "D". If you acquire area development rights, before signing the ADA, Bigfoot Forestry will identify the boundaries of each franchised territory you will develop. The boundaries of your development territory will be described in Part E of ATTACHMENT "A" to your ADA.
At least 7 days before you sign the ADA, Bigfoot Forestry will send you a complete execution copy of the ADA that includes: (a) a description of your development territory; (b) a description of each of the individual franchised territories that comprise your development territory; (c) your development fee; and (d) your development schedule. The ADA grants you the right and obligation to develop, open and operate multiple Bigfoot Forestry Businesses within a defined "development territory" according to a predetermined "development schedule".
The document also defines key terms related to the Area Development Agreement. For example, the "Development Territory" means the geographic area comprised by all of the individual Franchised Territories described in Part D of ATTACHMENT "A" on a combined basis. The "Development Schedule" means the schedule described in §4.1 and Part C of ATTACHMENT "A" for the development of the Bigfoot Forestry Businesses within the Development Territory.
