On each royalty fee due date, you must pay us a brand fund fee in the amount we designate from time to time (currently 1% of Gross Sales, but not to exceed 3% of Gross Sales). We will provide at least 60 days' notice before we increase the brand fund fee.

What This Means (2025 FDD)

According to the 2025 Bigfoot Forestry FDD, franchisees must pay the brand fund fee on each royalty fee due date. The brand fund is used to promote public awareness of the brand and improve the Bigfoot Forestry system. The brand fund fee is currently 1% of Gross Sales, but cannot exceed 3% of Gross Sales. Bigfoot Forestry will provide at least 60 days' notice before increasing the brand fund fee.

Bigfoot Forestry has the sole discretion in determining the content and other matters pertaining to marketing or advertising activities. Any surplus in the fund may be invested, and Bigfoot Forestry may lend money to the fund if there is a deficit. The fund is not a trust, and Bigfoot Forestry has no fiduciary obligations to franchisees with respect to its administration of the fund.

Bigfoot Forestry does not ensure that expenditures in a given geographic area are proportionate or equivalent to the brand fund fees paid by franchisees in that geographic area, or that franchisees benefit directly or in proportion to their brand fund fees. Bigfoot Forestry will prepare and make available to franchisees upon request an annual statement of fund operations, including deposits and disbursements. Bigfoot Forestry may suspend or discontinue the fund at any time upon 30 days' prior notice.

In addition to the brand fund fee, franchisees may also be required to pay a cooperative advertising fee on each royalty fee due date or such other date specified by the cooperative. This fee will not exceed 2% of Gross Sales. All cooperative advertising fees paid are credited towards the franchisee's Local Marketing Commitment.
