What This Means (2025 FDD)
Based on the 2025 Bigfoot Forestry Franchise Disclosure Document, the document does not specify a cure period for health or safety hazards. However, the FDD does state that franchisees must comply with OSHA standards and other industry-specific safety regulations. Failure to comply with these standards could lead to a default under the Franchise Agreement.
Item 11.15 discusses quality assurance programs and inspections, stating that franchisees must take all actions specified by Bigfoot Forestry within the period of time prescribed by them to rectify any non-compliance issues revealed by an inspection. Item 11.16 states that if a franchisee fails to cure a breach of standards or operating procedures within the time period prescribed by Bigfoot Forestry, the franchisor may impose a noncompliance fee of $500 per occurrence, and a separate $100 fee every 48 hours the same noncompliance issue remains uncured after the initial fee is imposed.
Since the FDD does not explicitly state the cure period for health or safety hazards, it is important for a prospective franchisee to ask Bigfoot Forestry about the specific cure periods and procedures related to health and safety violations. Understanding these procedures is crucial for ensuring the safety of employees and customers, as well as maintaining compliance with the Franchise Agreement and avoiding potential penalties or termination.
