What This Means (2025 FDD)
According to Bigfoot Forestry's 2025 Franchise Disclosure Document, a 'Competing Business' is defined based on specific criteria related to revenue, franchising activities, and support services. A business is considered a 'Competing Business' if it meets at least one of the following conditions.
First, if a business derives, or is reasonably expected to derive, at least 51% of its total gross sales from the sale of forestry mulching services, it is considered a 'Competing Business'. This means that if more than half of a business's revenue comes from forestry mulching, it directly competes with a Bigfoot Forestry franchise.
Second, any business that solicits, offers, or sells franchises or licenses for a business that meets the 51% revenue criterion is also classified as a 'Competing Business'. This includes businesses that are involved in franchising or licensing other forestry mulching services that would themselves be considered competing businesses. However, a 'Competing Business' does not include any Bigfoot Forestry Business operated under a valid franchise or license agreement with Bigfoot Forestry or its affiliates.
