If you acquire area development rights, we will identify the boundaries of each franchised territory you will develop before signing the ADA. In other words, before you sign the ADA we will designate the boundaries of each territory that will granted to you under each Franchise Agreement you sign. The total geographic area comprised by all of the individual franchised territories constitutes your "development territory". The boundaries of your development territory will be described in Part E of ATTACHMENT "A" to your ADA.

There is no specific minimum or maximum size for a development territory. Instead, the size of your development territory is determined based on the number of Bigfoot Forestry Businesses you commit to develop under the ADA. Each franchised territory that comprises the development territory will be determined using one of the 2 approaches described above (i.e., an area we designate that includes a minimum of 100,000 owneroccupied households or the area within a 50-mile radius from a central point we designate).

You must sign a separate Franchise Agreement for each Bigfoot Forestry Business you develop. Unless we agree otherwise, you may not provide Bigfoot Forestry Services at job sites within a given franchised territory prior to signing a Franchise Agreement for that territory. At least 7 days before you sign the ADA, we send you a complete execution copy of the ADA that includes: (a) a description of your development territory; (b) a description of each of the individual franchised territories that comprise your development territory; (c) your development fee; and (d) your development schedule.

Territorial Protections and Limitations

During the term of your Franchise Agreement and the term of your ADA (if applicable) we will not develop or operate, or license a third party to develop or operate, a Bigfoot Forestry Business that provides Bigfoot Forestry Services under our Marks at job sites located within your territory or development territory (if applicable) except as otherwise provided below with respect to Acquisitions and National Accounts.

According to Bigfoot Forestry's 2025 Franchise Disclosure Document, the 'development territory' for an area developer (ADA) is the total geographic area comprised of all the individual franchised territories that the area developer commits to develop under the Area Development Agreement (ADA). Before signing the ADA, Bigfoot Forestry will designate the boundaries of each franchised territory that will be granted to the developer under each Franchise Agreement they sign.
