What This Means (2025 FDD)
According to Bigfoot Forestry's 2025 Franchise Disclosure Document, the confidentiality agreement does define the term "Marks." The agreement specifies that "Marks" include all service marks, trademarks, trade names, and logos that Bigfoot Forestry designates for its franchisees to use. This includes the BIGFOOT FORESTRY® trademark and associated logos.
The definition extends to any distinctive trade dress used to identify a Bigfoot Forestry Business. This encompasses the equipment used, as well as the services or products sold. This definition is important because it clarifies what aspects of the Bigfoot Forestry brand are protected under the confidentiality agreement.
For a prospective franchisee, understanding this definition is crucial. It outlines the specific intellectual property that they are authorized to use and must protect. It also highlights the importance of maintaining the confidentiality of the brand's identity, as misuse could jeopardize the entire franchise system. Franchisees must ensure their employees and independent contractors also understand and adhere to these confidentiality terms, as outlined in the attached Confidentiality Agreement.
