What This Means (2025 FDD)
According to Big O Tires' 2025 Franchise Disclosure Document, a franchisee in Nevada can cancel their plan by submitting a written request to the Issuing Dealer. This request must include a copy of the plan and the current mileage on the vehicle.
During the first 30 days from the plan purchase date, the franchisee will receive a full refund (100% of the plan purchase price) from Big O Tires or the Issuing Dealer. After this initial 30-day period, the franchisee will receive a pro-rated refund of the purchase price. This refund will be issued within 45 days after the plan is returned to the Obligor.
If the refund is not made within 45 days of returning the plan, a penalty of 10% per month will be added to the refund amount. Big O Tires also retains the right to cancel the plan within the first 70 days for any reason. After 70 days, Big O Tires can only cancel the plan if there is material misrepresentation or fraud by the franchisee at the time of sale, or if the franchisee fails to pay the plan purchase price. If Big O Tires cancels the plan, the franchisee will receive a full refund (100% of the plan purchase price). It is important to note that in Nevada, no claims paid on the plan will be deducted from any refund, and cancellations by Big O Tires will not take effect until at least 15 days after a notice of cancellation is mailed to the franchisee. Furthermore, arbitration does not apply in Nevada.
