What This Means (2025 FDD)
According to Big O Tires's 2025 Franchise Disclosure Document, franchisees must participate in Local Groups. Specifically, franchisees are required to participate in and adhere to the decisions made by any Local Group that is established and operated under standards and guidelines prescribed or approved by Big O Tires. However, franchisees are prohibited from entering into any agreements that fix prices or allocate customers or territories if such agreements would violate applicable laws. This requirement is outlined in Section 10.01(i) of the Franchise Agreement.
This requirement means that as a Big O Tires franchisee, you must actively engage with any Local Groups established by Big O Tires and follow their guidelines. These Local Groups are intended to foster collaboration and ensure consistent standards across different franchise locations. However, it is crucial to ensure that any decisions made by these groups comply with all applicable laws, particularly those related to pricing and market allocation.
Participating in Local Groups can offer benefits such as shared marketing efforts, collective purchasing power, and a platform for exchanging best practices with other franchisees. However, franchisees must remain vigilant to ensure that the group's activities do not violate any antitrust or competition laws. Franchisees should seek legal counsel if they have any concerns about the legality of the group's decisions.
Overall, the requirement to participate in Local Groups reflects Big O Tires's emphasis on standardization and collaboration within its franchise system. While this participation can offer advantages, franchisees must be aware of the legal limitations and ensure that their involvement remains compliant with all applicable regulations.
