What This Means (2025 FDD)
The 2025 Big O Tires Franchise Disclosure Document does not explicitly state the specific condition in which a tenant must leave the premises upon termination of the lease. However, it does state that if the tenant complies with all lease terms, the security deposit will be returned within fifteen (15) days after the lease ends and after the landlord receives possession of the premises.
Item 23 includes several stipulations regarding the relationship between Big O Tires, the landlord, and the tenant (franchisee). These stipulations primarily concern Big O Tires' rights and options in the event of a default or termination of the franchise agreement. For example, Big O Tires has the option to take over the lease under certain conditions, and the landlord agrees to accept Big O Tires as a substitute tenant.
To fully understand the required condition of the premises upon lease termination, a prospective Big O Tires franchisee should review the lease agreement carefully and consult with the franchisor about any specific requirements or expectations. It would also be prudent to seek legal counsel to ensure a clear understanding of all obligations.
