What This Means (2025 FDD)
According to Big Blue Swim School's 2025 Franchise Disclosure Document, the Managing Owner, general managers, and assistant managers are solely responsible for managing and operating the Big Blue Swim School and supervising its employees. This means that as a franchisee, you retain full control over the day-to-day operations of your swim school and the management of your staff. Big Blue Swim School emphasizes that they are not the employer or joint employer of the School's employees.
This delineation of responsibilities extends to various aspects of employment, including employee selection, promotion, termination, hours worked, rates of pay, benefits, work assigned, discipline, and the handling of grievances and complaints. The franchisee is required to inform all school personnel that they (the franchisee) are the employer and that Big Blue Swim School, as the franchisor, is not involved in these employment-related activities.
To ensure clarity and legal compliance, Big Blue Swim School requires franchisees to obtain a signed acknowledgment from all school employees confirming that the franchisee, and not Big Blue Swim School, is their employer. This measure protects Big Blue Swim School from potential liabilities related to labor and employment practices at the franchised location. While Big Blue Swim School may offer guidance on supervisory employee training methods, the franchisee maintains sole responsibility for the employment terms and conditions of all school employees.
