What This Means (2025 FDD)
According to Big Blue Swim School's 2025 Franchise Disclosure Document, the franchisee is primarily responsible for locating, evaluating, and selecting the site for each school. While Big Blue Swim School does not search for or select the site for the franchisee, they may propose potential sites using local commercial real estate brokers within the franchisee's Site Selection Area or Territory. These proposals are based on Big Blue Swim School's criteria, considering factors like population density, visibility, traffic flow, competition, accessibility, size, and other commercial characteristics.
The franchisee must provide Big Blue Swim School with all requested information and materials to assess each proposed site. Big Blue Swim School will review potential sites identified by the franchisee within the Territory and may visit the Territory once (for no additional fee) to review potential sites for each school to be constructed. However, Big Blue Swim School has the right to require reimbursement for out-of-pocket expenses for each site visit after the first per-Swim School visit. Big Blue Swim School also has the right to condition their acceptance of a proposed site, or a proposed site visit, on the franchisee first sending complete site reports and other requested materials.
Big Blue Swim School agrees to use reasonable efforts to review and accept (or not accept) sites proposed by the franchisee within 30 days after receiving all requested information and materials. The franchisee may not proceed with a site that Big Blue Swim School has not accepted. Big Blue Swim School will not unreasonably withhold acceptance of a site if it aligns with favorable or successful sites from the past. However, Big Blue Swim School has the absolute right to reject any site not meeting their criteria or require the franchisee to acknowledge in writing that a preferred site is accepted but not recommended due to incompatibility with certain factors. Ultimately, the franchisee must evaluate and approve the selection of the School's site.
