What This Means (2025 FDD)

According to the 2025 FDD, the franchisee is responsible for the expenses related to the design, construction, and development of their Big Blue Swim School. While Big Blue Swim School provides guidance on the school's design, construction, and development, the franchisee must cover all costs associated with these activities. This includes paying all fees due to service providers and vendors involved in the project.

The design, construction, and development of the Big Blue Swim School must adhere to the franchisor's guidelines and mandatory specifications, referred to as "Plans." These Plans encompass requirements for dimensions, design, interior layout, improvements, color scheme, décor, finishes, signage, and operating assets. The franchisee must ensure that their Project/Construction Manager or third-party vendor adapts the Plans to comply with all applicable federal, state, or local laws, codes, ordinances, and regulations, including those under the Americans with Disabilities Act, as well as any lease requirements or restrictions.

In practice, this means that a prospective Big Blue Swim School franchisee needs to budget for all costs related to building out their location. While the franchisor provides the design plans and specifications, the franchisee is responsible for managing the construction process and ensuring compliance with all legal and regulatory requirements. This can be a significant expense, and franchisees should carefully consider these costs when evaluating the financial feasibility of opening a Big Blue Swim School franchise.
