What is the purpose of the System Website for Big Blue Swim School?

We or our designees may establish a website or series of websites (with or without restricted access) for the BIG BLUE Swim School network: (1) to advertise, market, identify, and promote BIG BLUE Swim Schools, the services and products they offer, and/or the BIG BLUE Swim School franchise opportunity; (2) to help us operate the BIG BLUE Swim School network; and/or (3) for any other purposes we deem appropriate for BIG BLUE Swim Schools or other business activities in which we engage (collectively, the "System Website"). The System Website need not give you a separate interior webpage or "micro-site" referencing your School. We will own all intellectual property and other rights in the System Website and all information it contains, including domain names or URL, the log of "hits" by visitors, any personal or business data visitors supply, and all information relating to the School's customers. We will control, and may use the Brand Fund's assets to develop, maintain, operate, update, and market, the System Website.
All Marketing Materials you develop for the School must comply with Brand Standards and contain notices of the System Website's URL as we specify. You may not develop, maintain, or authorize any digital marketing or social media mentioning or describing the School or displaying any Marks without our prior written approval and, if applicable, without complying with our Brand Standards for such digital marketing and social media. Except for the System Website and approved digital marketing and social media, you may not conduct commerce or directly or indirectly offer or sell any products or services using any digital marketing, social media, or website. We have the right to maintain websites other than the System Website and to offer and sell services and products under the Marks from the System Website, another website, or otherwise over the Internet without payment or other obligation to you.

What This Means (2025 FDD)
According to the 2025 FDD, Big Blue Swim School may establish a System Website for several purposes. These include advertising, marketing, identifying, and promoting Big Blue Swim School, its services, products, and franchise opportunities. The System Website can also help Big Blue Swim School operate its network and be used for any other purposes the company deems appropriate for its business activities.
Big Blue Swim School retains ownership of all intellectual property and rights related to the System Website, including domain names, visitor data, and customer information. The Brand Fund, which franchisees contribute to (up to 3% of gross revenue, currently set at 2%), may be used to develop, maintain, operate, update, and market the System Website.
As a franchisee, you must ensure that all marketing materials include the System Website's URL as specified by Big Blue Swim School. You need prior written approval to engage in digital marketing or social media activities that mention or describe your school or display any of Big Blue Swim School's marks. Franchisees are generally prohibited from conducting commerce or offering products or services through digital channels other than the System Website and approved digital marketing. Big Blue Swim School reserves the right to maintain other websites and sell services and products under its marks over the Internet without any obligation to compensate the franchisee.
