What This Means (2025 FDD)
According to Big Blue Swim School's 2025 Franchise Disclosure Document, franchisees must acquire the School's point-of-sale system from suppliers that Big Blue Swim School designates or approves. Along with the point-of-sale system, franchisees must also acquire the School's furniture, fixtures, equipment, Computer System, accounting and bookkeeping system, business software (including background check services, credit card processing services, customer feedback software, customer review mitigation, and recruiting tracking software), worker's compensation support, payroll and employee benefits software, signage, uniforms, chemicals and other supplies, pump, HVAC, pool systems (including the pump room and pump notifications), pool materials (including swim platforms, lane tents, teaching tools, goggles, swim diapers, and swimsuits), building-management systems, marketing (including search engine optimization, digital, print, and email), graphic design services, adaptive swim lessons, lifeguard training, and Loyalty Program Media services from designated or approved suppliers.
Big Blue Swim School maintains Brand Standards that regulate the types, models, and brands of furniture, fixtures, signs, and equipment (including components of and required software licenses for the Computer System) required for the School. These standards also cover required, authorized, and unauthorized services and products, as well as designated and approved manufacturers, suppliers, and/or distributors of items and services. Big Blue Swim School has the right to designate exclusive sources, which might be themselves or an affiliate, for a particular item or service, or refuse a franchisee's requests for any reason if they believe it is in the best interest of the Big Blue Swim School network.
Franchisees have the option to propose a supplier or distributor that Big Blue Swim School has not yet approved. In this case, the franchisee must demonstrate to Big Blue Swim School's satisfaction that the quality and functionality of the item or service are equivalent to those of the item or service it replaces. The supplier or distributor must also be reputable, financially responsible, and adequately insured for product-liability claims. The franchisee is responsible for covering any actual expenses Big Blue Swim School incurs to determine whether the items, services, suppliers, or distributors meet their requirements and specifications. Big Blue Swim School will then decide within a reasonable time (up to 120 days) whether to approve the proposed supplier.
Big Blue Swim School can also periodically require franchisees to participate in certain test programs and consumer surveys for new services, products, and/or Operating Assets. While Big Blue Swim School need not reimburse the related costs, they will not require franchisees to spend unreasonable amounts to participate. Alternatively, Big Blue Swim School has the right to use the Brand Fund to pay for these costs.
