- Subfranchising and Sublicensing Rights. This DRA does not give you any right to franchise, license, subfranchise, or sublicense others to construct, develop, and operate BIG BLUE Swim Schools. Only you (and/or your Approved Affiliates) have the right to construct, develop, open, and operate BIG BLUE Swim Schools pursuant to this DRA. This DRA also does not give you (or your Approved Affiliates) any independent right to use the BIG BLUE SWIM SCHOOL® trademark or the other Marks. The right to use the Marks is granted only under a franchise agreement signed directly with us. This DRA only grants you potential development rights if you fully comply with its terms.

What This Means (2025 FDD)
According to the 2025 Big Blue Swim School Franchise Disclosure Document, the Development Rights Agreement (DRA) does not grant any subfranchising or sublicensing rights. The DRA explicitly states that only the franchisee (and/or their Approved Affiliates) have the right to construct, develop, open, and operate Big Blue Swim Schools under the DRA.
This means that a franchisee entering into a DRA with Big Blue Swim School is solely responsible for developing and operating the swim schools within their designated territory. They cannot delegate or transfer these development rights to another party through subfranchising or sublicensing. The rights to use Big Blue Swim School's trademarks are also exclusively granted through a direct franchise agreement with the company, not through the DRA itself.
This restriction ensures that Big Blue Swim School maintains control over the quality and consistency of its brand and operations. It also means that prospective franchisees need to be prepared to directly manage the development and operation of each swim school themselves or through approved affiliates, as they cannot rely on subfranchisees or sublicensees to fulfill these responsibilities.
