What This Means (2025 FDD)
According to the 2025 Big Blue Swim School Franchise Disclosure Document, the Development Rights Agreement (DRA) term concludes under specific conditions. The term starts on the effective date and ends when the franchisee (or their Approved Affiliate) opens the final Big Blue Swim School outlined in the development schedule.
Alternatively, the DRA can terminate earlier if it is otherwise terminated according to its terms. Regardless of these conditions, the DRA term will end no later than a specified date, which is not included in the excerpt.
Big Blue Swim School retains the right to terminate the DRA if the franchisee fails to meet deadlines in the development schedule or any other obligations outlined in the DRA, particularly if these defaults are not subject to a cure period. This means that franchisees must adhere strictly to the agreed-upon development timeline and contractual obligations to maintain their development rights.
