What This Means (2025 FDD)
According to Big Blue Swim School's 2025 Franchise Disclosure Document, school managers, officers, and directors must sign confidentiality and other agreements, including non-compete agreements, that Big Blue Swim School pre-approves. The franchisor's right to pre-approve these forms is solely to protect confidential information and the competitiveness of Big Blue Swim Schools.
This requirement ensures that key personnel are legally bound to protect the franchisor's sensitive business information and refrain from engaging in activities that could harm the brand's competitive position. The franchisor retains the right to pre-approve these agreements, allowing them to maintain control over the terms and scope of these protections.
However, Big Blue Swim School does not control the forms or terms of employment agreements franchisees use with school employees and is not responsible for the franchisee's labor relations or employment practices. This clarifies that while certain agreements must be in place to protect the brand, the franchisee maintains autonomy over their employment practices.
