What This Means (2025 FDD)
According to the 2025 Big Air Trampoline Park FDD, if a franchisee is deemed to lack sufficient business experience, they must designate a Designated Business Manager. This manager acts as the operating manager for the Big Air Trampoline Park business and/or directly supervises the franchisee's obligations as a Multi-Unit Developer, if applicable.
The Designated Business Manager is required to attend and successfully complete the initial training program. They must also adhere to the obligations outlined in the Franchise Agreement, the Multi-Unit Development Agreement (if applicable), and the Operations Manual. This ensures the manager is well-versed in the operational standards and requirements of Big Air Trampoline Park.
Furthermore, the Designated Business Manager must agree to assume the confidentiality and non-competition obligations of the franchisee. This is detailed in Attachment B to the Franchise Agreement. This measure protects Big Air Trampoline Park's proprietary information and prevents unfair competition during and after the franchise agreement term. In essence, the Designated Business Manager takes on a significant role, acting as a surrogate for the franchisee in managing the business and upholding the brand's standards and legal obligations.
