What This Means (2025 FDD)
According to Bhc's 2025 Franchise Disclosure Document, a franchisee can only use the Marks and Intellectual Property on the Internet or other electronic media if specifically authorized by Bhc in the Operations Manual or in writing. This authorization is required for using the Marks and Intellectual Property in connection with the operation of the franchised business.
This means that a Bhc franchisee needs to get explicit permission from Bhc before using any of Bhc's trademarks, service marks, logos, or other intellectual property online. This includes on websites, social media, or any other digital platform. The franchisee is also responsible for ensuring that their employees and agents comply with these rules.
This requirement is fairly standard in franchising, as franchisors need to protect their brand and ensure consistent messaging across all locations and platforms. By controlling the use of its Marks and Intellectual Property online, Bhc can maintain brand integrity and prevent unauthorized or inappropriate use. A prospective franchisee should carefully review the Operations Manual and any written authorizations to understand the scope of permitted online activities and ensure compliance with Bhc's policies.
Additionally, the FDD states that franchisees may use the Bhc website and other internet or social media platforms only as authorized by Bhc in the franchise agreement, operations manual, or in writing to market their franchised business. Franchisees are prohibited from establishing an independent website or social networking media dedicated to marketing the franchised business or registering an internet domain or social networking media name using any of the Marks.
