What This Means (2025 FDD)
According to Bhc's 2025 Franchise Disclosure Document, a Master Franchisee must contact online review sites and other online directories and websites that have referenced the Master Franchised Bhc Restaurant within 18 months prior to the termination, cancellation, or expiration date of the Franchise Agreement. This action is required regardless of the reason for termination, including breach, default, non-renewal, lapse of time, or other causes.
The Master Franchisee is responsible for requesting the removal of all trademarks used in connection with the former Bhc restaurant, including the physical address, and all former reviews from the period the Master Franchisee operated as a Bhc Master Franchisee. This obligation is in addition to other requirements, such as discontinuing the use of Bhc's marks, repainting the business premises, and removing distinctive elements of the trade dress to avoid any impression of affiliation with Bhc.
This requirement ensures that after a franchise agreement ends, the public is not misled into thinking the former franchisee is still part of the Bhc system. It also protects Bhc's brand reputation by ensuring that outdated or potentially inaccurate information is removed from online platforms. Master Franchisees should be aware of this obligation and prepared to act promptly to comply with it upon termination of their agreement.
