Answer from 2025 FDD Document

We do not make any representation about a franchisee's future financial performance or the past financial performance of company-owned or franchised BHC Restaurants. We also do not authorize our employees or representatives to make any such representations either orally or in writing. If you are purchasing an existing BHC Restaurant, however, we may provide you with the actual records of that BHC Restaurant. If you receive any other financial performance information or projections of your future income, you should report it to the franchisor's management by contacting the Franchise Development Department at 3435 Wilshire Blvd., Suite 460, Los Angeles, CA 90010, 323-424-3733, the Federal Trade Commission, and the appropriate state regulatory agencies.

What This Means (2025 FDD)

According to Bhc's 2025 Franchise Disclosure Document, if a prospective franchisee receives any financial performance information or projections of future income that are not included in Item 19 of the FDD, they should report it to Bhc's Franchise Development Department. The contact information for the Franchise Development Department is 3435 Wilshire Blvd., Suite 460, Los Angeles, CA 90010, 323-424-3733.

This instruction is important because Bhc does not authorize its employees or representatives to make any financial performance representations, either orally or in writing, beyond what is provided in Item 19. By directing franchisees to report unauthorized financial information, Bhc aims to maintain transparency and prevent misleading information from being disseminated during the franchise sales process. This protects both the prospective franchisee and the integrity of the Bhc franchise system.

In addition to reporting to Bhc, the FDD also advises reporting such instances to the Federal Trade Commission and the appropriate state regulatory agencies. This provides further avenues for investigation and ensures compliance with franchise regulations. Prospective franchisees should take this instruction seriously and promptly report any unauthorized financial claims to protect their investment and ensure they are making informed decisions based on accurate information.
