- (g) Unless otherwise agreed to in writing by Franchisee and Franchisor, Franchisee has the sole responsibility for locating, securing, and obtaining suitable premises for Franchisee's Franchised BHC Restaurant.

What This Means (2025 FDD)
According to Bhc's 2025 Franchise Disclosure Document, the franchisee is primarily responsible for locating, securing, and obtaining suitable premises for their Franchised Bhc Restaurant, unless otherwise agreed to in writing with Bhc. This responsibility includes both franchisees and master franchisees.
The FDD specifies that the premises must be acceptable to Bhc and secured by the franchisee (or master franchisee) within four months of the agreement's effective date. Franchisees are expected to promptly identify potential sites that meet Bhc's standards and submit the required information for review. Bhc may assist in the site selection process but is not obligated to do so. Bhc reserves the right of final review and consent to any location.

Failure to secure an acceptable site within the specified timeframe may result in the termination of the franchise agreement.
