What This Means (2025 FDD)
According to Bhc's 2025 Franchise Disclosure Document, Bhc owns all information on the Computer System, including customer data and contact information. As a Bhc franchisee, you consent to Bhc using this information in any way it sees fit, while adhering to privacy laws and policies. This includes marketing other products and services that are not necessarily Bhc products or specifically authorized by Bhc.
This means that while you, as the franchisee, collect customer data through the Computer System, you do not own that data. Bhc has the right to utilize this data for its own purposes, such as marketing and business development. This is a common practice in franchising, where the franchisor seeks to maintain control over brand-related data to ensure consistency and leverage marketing opportunities across the entire franchise system.
For a prospective franchisee, this underscores the importance of understanding the franchisor's data usage policies and ensuring compliance with all applicable privacy laws. While Bhc retains ownership of the data, franchisees are responsible for the proper collection and handling of customer information at their individual locations. Franchisees should clarify with Bhc how they can access and potentially utilize some of this data for local marketing efforts, while remaining compliant with the agreement.
