What This Means (2025 FDD)
According to Bhc's 2025 Franchise Disclosure Document, as a Master Franchisee, you are responsible for preparing, amending, and annually updating a franchise disclosure document (Subfranchise FDD) to use in offering and selling subfranchises for Bhc Restaurants to prospective subfranchisees. However, upon your request, Bhc will provide relevant information about themselves and their business to include in your Subfranchise FDD.
This means that while the primary responsibility of creating and maintaining the Subfranchise FDD falls on you as the Master Franchisee, Bhc will assist by providing necessary information about the company. This support is crucial because the Subfranchise FDD must accurately represent Bhc and its operations to potential subfranchisees. The information Bhc provides will likely include details about the company's history, financial performance, and the overall franchise system, ensuring that the Subfranchise FDD meets legal and regulatory requirements.
It is important to note that you, as the Master Franchisee, must still independently ensure that the Subfranchise FDD complies with all applicable federal and state laws, including franchise registration and disclosure laws. Requesting and incorporating the information provided by Bhc is just one part of your overall responsibility to create a complete and accurate disclosure document for prospective subfranchisees.
