after Franchisee has located and secured suitable premises (that Franchisor consents to) for its Franchised BHC Restaurant, Franchisee has not commenced operation of the Franchised Business within fourteen (14) months after the Effective Date, Franchisor may terminate this Agreement effective on written notice.
- (c) Franchisor may, but is not obligated to, assist Franchisee in the site selection process. However, Franchisor reserves the sole right of final review and consent to any location of the Franchised BHC Restaurant. What This Means (2025 FDD)
According to Bhc's 2025 Franchise Disclosure Document, Bhc does not guarantee that a Bhc business will be successful at any location, even if the location has been approved by Bhc. This means that while Bhc assists in the site selection process and provides a sample prototype layout and floor plan, the franchisee bears the ultimate responsibility for selecting a viable location and ensuring the success of their business. Bhc also charges a Site Design Review Fee of $2,500 and a Site Review Fee of $2,000 to $4,000, which the franchisee must pay. The franchisee is also responsible for employing architects, designers, and engineers to adapt the plans and specifications for the restaurant.
Prospective franchisees should carefully consider the risks involved in selecting a location and operating a Bhc franchise. While Bhc provides support and resources, the success of the business depends on various factors, including the franchisee's business acumen, local market conditions, and competition.
