Is the Franchisor's approval of a potential Subfranchisee or Bhc Restaurant a guarantee of success?
Bhc Franchise · 2025 FDDAnswer from 2025 FDD Document
To the extent Franchisor exercises its approval rights under this paragraph, Franchisor's approval of any potential Subfranchisee or potential BHC Restaurant is in no way a guarantee as to the success of that potential Subfranchisee or potential BHC Restaurant, but only an indication that the potential Subfranchisee or potential BHC Restaurant generally meets Franchisor's then-current minimum requirements.

What This Means (2025 FDD)
According to Bhc's 2025 Franchise Disclosure Document, the Franchisor's approval of a potential subfranchisee or Bhc Restaurant does not guarantee success. While Bhc reserves the right to approve potential subfranchisees and restaurant locations, this approval only indicates that the candidates or locations meet the minimum requirements at the time of approval.
Bhc's approval process for restaurant premises involves analyzing demographic information, income figures, traffic patterns, visibility, population density, competition, zoning, parking, accessibility, and other relevant circumstances. However, even with this thorough review, Bhc does not guarantee the success of the business at that location. The franchisee bears the ultimate responsibility for the success of their Bhc restaurant.
This disclaimer is typical in franchising. While the franchisor provides guidance and support, the franchisee's own management skills, local market conditions, and other factors ultimately determine the success of the business. Prospective Bhc franchisees should carefully consider these factors and conduct their own due diligence before investing in a franchise.
