What This Means (2025 FDD)
According to Bhc's 2025 Franchise Disclosure Document, if the franchisor identifies any maintenance deficiencies at the franchised restaurant, the franchisee must immediately and completely resolve them to the franchisor's satisfaction. This requirement ensures that all Bhc restaurants maintain a consistent standard of quality and appearance, which is crucial for protecting the brand's image.
This obligation extends to all equipment used at the franchised location, which must be maintained on an as-needed basis. Additionally, franchisees are required to make upgrades to equipment and any technology used in the restaurant as mandated by Bhc. These measures are in place to ensure that the restaurant operates efficiently and in accordance with the latest standards set by the franchisor.
Furthermore, Bhc retains the right to conduct reviews and inspections of the franchisee's restaurant during normal business hours. Upon receiving notice from Bhc or its representatives, the franchisee must promptly take the necessary steps to correct any deficiencies identified during these inspections. If the franchisee fails to correct the deficiencies by the time of the initial re-inspection, Bhc's representatives may conduct additional re-inspections until the issues are resolved or until Bhc deems the franchisee to be in material breach of the agreement. The franchisee is responsible for covering all accommodation, transportation, meals, daily allowances, and other costs and expenses incurred by Bhc's personnel in connection with these re-inspections.
