What This Means (2025 FDD)
According to Bhc's 2025 Franchise Disclosure Document, franchisees are restricted in their use of trademarks, trade names, service marks, insignias, or logo types. Specifically, franchisees cannot use, display, or permit the use or display of any of these items unless they are the Marks approved by Bhc for use in connection with the franchised business. This restriction applies to the franchisee, any Principal Equity Operator, and any employee, agent, or representative thereof.
This means a Bhc franchisee must adhere strictly to the branding and marketing materials approved by Bhc. They cannot introduce any unauthorized logos, slogans, or trade names in their restaurant's signage, advertising, or other promotional materials. This is to ensure brand consistency and protect the integrity of Bhc's trademarks.
The franchisee can only use the Marks and Intellectual Property on the Internet or other electronic media in the manner and as specifically authorized by Bhc in the Operations Manual or otherwise in writing. Franchisees are responsible for ensuring that all employees and agents properly use the Marks and Intellectual Property in compliance with the franchise agreement.
These stipulations are typical in franchising, as franchisors like Bhc need to maintain tight control over their brand to ensure a consistent customer experience and protect their intellectual property. Franchisees should carefully review the Operations Manual and any written guidelines from Bhc to understand exactly which marks they are authorized to use and how they should be displayed.
