At this time, there is no advertising council of franchisees that advises us regarding advertising and promotional programs or policies for Franchised BHC Restaurants generally. Franchisor does not currently require Franchisees to participate in a local or regional advertising cooperative. No local or regional advertising cooperative exists in Franchisor's system at this time.

What This Means (2025 FDD)

According to Bhc's 2025 Franchise Disclosure Document, there is currently no advertising council of franchisees that advises Bhc regarding advertising and promotional programs or policies. Bhc also does not require franchisees to participate in a local or regional advertising cooperative, and no such cooperative exists within the Bhc system at this time. This indicates that Bhc makes all advertising and promotional decisions.

As a Bhc franchisee, you will not have a formal channel to influence advertising strategies or provide input on promotional campaigns at the national or regional level. However, franchisees are required to engage in local advertising, spending at least 1% of their annual gross revenues on local marketing, advertising, and promotion. These local advertising plans must be pre-approved by Bhc.

While franchisees do not have an advertising council, Bhc may impose additional assessments for special advertising or promotional activities on a regional or system-wide basis if two-thirds of affected franchised Bhc restaurants agree to the assessment through an affirmative vote. Franchisees are also required to participate in any gift card, customer loyalty, referral, and other contests and promotions that Bhc arranges, requires, or authorizes.
