What This Means (2025 FDD)
According to Bhc's 2025 Franchise Disclosure Document, Bhc may change the standard menu format at any time. While a standard menu format and menu items are required, Bhc has the authority to implement changes to that format.
Any changes, additions, or deletions to the menu format must be approved in writing by Bhc before a franchisee can implement them. If a franchisee makes changes to the standard menu without Bhc's approval, or if the franchisee's products deviate from the descriptions in Bhc's approved menu, the franchisee agrees to indemnify and hold Bhc harmless from any resulting losses, damages, costs, or expenses, including attorney's fees.
This clause ensures that Bhc maintains control over its brand standards and menu offerings, allowing it to adapt to market trends and customer preferences. For a prospective franchisee, this means they must adhere to Bhc's menu standards and obtain written approval for any desired changes, bearing the financial responsibility for unauthorized deviations.
