Answer from 2025 FDD Document

THIS AGREEMENT GRANTS MASTER FRANCHISEE ONLY THE RIGHT TO OPERATE THE FRANCHISED BUSINESS AT MASTER FRANCHISED BHC RESTAURANT AND NOWHERE ELSE UNLESS FRANCHISOR SPECIFICALLY ALLOWS MASTER FRANCHISEE TO OFFER BHC PRODUCTS ELSEWHERE. ALL OTHER RIGHTS ARE RETAINED BY AND RESERVED TO FRANCHISOR.

What This Means (2025 FDD)

According to Bhc's 2025 Franchise Disclosure Document, a Master Franchisee is generally restricted to operating the franchised business solely at the Master Franchised Bhc restaurant. However, the document specifies one exception: a Master Franchisee may offer Bhc products elsewhere if Bhc specifically allows it.

This permission must be granted by Bhc, indicating that the franchisor retains control over where its products are sold and how its brand is represented. This ensures that Bhc can maintain consistency and quality across all points of sale, protecting the brand's reputation.

For a prospective Master Franchisee, this means that any desire to sell Bhc products outside of the established restaurant location would require explicit approval from Bhc. It would be prudent to discuss potential alternative sales channels with Bhc during the due diligence process to understand the franchisor's openness to such arrangements and the conditions under which they might be approved.
