Does Bhc assist Affiliate Franchisees in locating a site and negotiating the purchase or lease of the site?

Before you open your Affiliate Franchised BHC Restaurant, we will:
(i) Not assist your Affiliate Franchisee in locating a site and negotiating the purchase or lease of the site.
(ii) Not provide assistance with conforming the premises to local ordinances and building codes and obtaining any required permits.
(iii) Provide you with a general plan for the layout, constructing, remodeling, and furnishing your Affiliate Franchised BHC Restaurant.
You are responsible for the costs of preparing architectural, engineering and leasehold improvement drawings and site plans, which you must submit to us for our review and approval before you begin leasehold improvement of your Affiliate Franchised BHC Restaurant.
You are responsible for the costs of leasehold improvement and remodeling.

What This Means (2025 FDD)
According to Bhc's 2025 Franchise Disclosure Document, Bhc does not assist its Affiliate Franchisees in locating a site or negotiating the purchase or lease of a site. The franchisee is responsible for these tasks. However, Bhc does use available demographic information to evaluate the site and the area in which it is located, and analyze area income figures, traffic patterns, visibility, population density, competition, zoning, parking, accessibility, and other related, relevant circumstances.
Bhc requires that the franchisee locate and secure a site that is acceptable to Bhc within four months of signing the Master Franchise Agreement (MFA). Bhc has 30 days to approve the proposed site after the franchisee submits all requested information. If Bhc rejects the site, the franchisee must propose an alternative location. If an acceptable site is not found within four months of signing the MFA, Bhc may cancel the agreement.
While Bhc does not assist in site selection or lease negotiation, they do provide a general plan for the layout, construction, remodeling, and furnishing of the Affiliate Franchised Bhc Restaurant. The franchisee is responsible for the costs of preparing architectural, engineering, and leasehold improvement drawings and site plans, which must be submitted to Bhc for review and approval before any leasehold improvements are made. The franchisee is also responsible for the costs of leasehold improvements and remodeling.
