What This Means (2025 FDD)
According to the 2025 Bft Franchise Disclosure Document, a Form of General Release is included as an exhibit. Specifically, Exhibit G is identified as the Form of General Release. This document is also referred to as the BFT FRANCHISE SPV, LLC GENERAL RELEASE OF ALL CLAIMS.
Furthermore, the FDD indicates that franchisees may be required to execute a general release in a form and substance satisfactory to Bft when acquiring a Successor Franchise. This release would cover any claims the franchisee and its related parties may have against Bft, its affiliates, and their respective owners, officers, directors, employees, agents, successors, and assigns.
This requirement is tied to the franchisee's eligibility to acquire a Successor Franchise, which allows for an additional ten-year term. The franchisee must execute Bft's current form of franchise agreement for Bft Studios, modified to reflect the successor franchise, prior to the expiration of the original term. The provisions of the Successor Franchise Agreement may differ from the original agreement, including changes in royalty and advertising fees. The execution of the general release is a condition for Bft to grant the Successor Franchise.
