What This Means (2025 FDD)

According to Bft's 2025 Franchise Disclosure Document, Confidential Information encompasses all data pertaining to the System, the development, and the operation of the Bft studio. This includes, but is not limited to, the Learning Management System, training programs, member and supplier lists, customer data, and any other proprietary information or know-how specific to Bft.

However, the Franchise Disclosure Document explicitly excludes certain types of information from the definition of "Confidential Information". Specifically, information, knowledge, or know-how that is already lawfully known to the public without any violation of applicable laws or obligations to Bft or its affiliates is not considered confidential. Additionally, any Restricted Data is excluded from the definition of Confidential Information.

For a prospective franchisee, this means that information already in the public domain is not subject to the confidentiality restrictions imposed by the franchise agreement. However, it is important to understand what Bft considers "Restricted Data" as this is also excluded from the definition of confidential information.
