What This Means (2025 FDD)
According to Bft's 2025 Franchise Disclosure Document, if Bft and the franchisee cannot agree on a site for the studio, Bft has the option to extend the time for the franchisee to obtain a site or terminate the Franchise Agreement. This is an important consideration for prospective franchisees as site selection is a critical step in establishing a Bft studio.
Bft does provide site selection assistance to franchisees, including current written site selection guidelines and contact information for local real estate brokers familiar with Bft's site selection criteria. Bft also uses a software program to evaluate the demographics of a market area for site selection approval. Franchisees are responsible for the costs associated with locating and developing a premises for their studio, as well as constructing, equipping, and remodeling the premises according to Bft's System Standards.
Franchisees are typically given 90 days from the execution of the Franchise Agreement to secure Bft's approval of an Authorized Location. Failure to do so may result in the termination of the Franchise Agreement. Bft also has the right to review any lease or purchase agreement for a proposed location before the franchisee enters into such an agreement and may condition its approval on certain terms, including specific lease terms and a written representation from the landlord ensuring the franchisee's right to operate the studio throughout the term of the Franchise Agreement.
Given these factors, it is crucial for prospective Bft franchisees to carefully review Bft's site selection criteria, seek appropriate professional advice, and proactively engage with Bft during the site selection process to mitigate the risk of disagreement and potential termination of the Franchise Agreement.
