Although Franchisee must comply with
Franchisor's advertising policy, Franchisee will not be prohibited from selling any product or service at a price above or below the suggested retail price unless Franchisor imposes a maximum price or minimum price for such product or service.

What This Means (2025 FDD)
According to Bft's 2025 Franchise Disclosure Document, franchisees are generally permitted to set prices above or below the suggested retail price. However, this is conditional. Bft may, subject to applicable laws, establish fixed maximum or minimum prices for products or services. If Bft does set these maximum or minimum prices, the franchisee is obligated to follow them.
Bft may consent to changes in local pricing if the franchisee needs to respond to unique local marketing conditions, competition, or expenses, or to comply with changes in state or federal anti-trust laws. Bft also retains the right to change or eliminate its pricing program or switch from required to recommended pricing in the future, consistent with state or federal law.
Even if Bft does not impose maximum or minimum prices, it may require franchisees to comply with an advertising policy. This policy could prohibit franchisees from advertising prices that differ from Bft's suggested retail price. Despite this advertising restriction, franchisees are generally not prohibited from selling products or services at prices above or below the suggested retail price, unless Bft has set a maximum or minimum price.
