Must I use Beyond Juicery Eatery's Designated Supplier to assist in site selection?

You must use our Designated Supplier to assist you in your site selection.
We do not have any experience or expertise in selecting real estate sites in the geographic area where your Restaurant will be located.
We will review the Site Information provided by you for the proposed site for your Restaurant, but you will be solely responsible for selecting the location for your Restaurant.
The Site Information for your proposed site will include information on the demographics of the market area, traffic patterns, a description of the character of the neighborhood, the competition in the area of the proposed site, the size, appearance, and other characteristics of the premises of the proposed site of your Restaurant and other information requested by us.
Although there is no time limit for us to review the Site Information provided by you, we will generally complete our review of the Site Information within forty-five (45) days after receipt.
We have no obligation, duty, or liability to you resulting from the site selected by you or the purchase or lease of your Location.
We will review the proposed lease for the site you select for your Restaurant and may charge you a Lease Review Fee.
This review will be to determine whether the lease complies with the terms of the Franchise Agreement, and not to provide any business, economic, legal, or real estate advice or analysis.
We can terminate the Franchise Agreement if you fail to provide the Site Information or fail to purchase or lease a site for your Restaurant within one hundred eighty (180) days after the date of the Franchise Agreement. (See Article 4 of the Franchise Agreement).

What This Means (2025 FDD)
According to Beyond Juicery Eatery's 2025 Franchise Disclosure Document, franchisees must use Beyond Juicery Eatery's Designated Supplier to assist in site selection. While Beyond Juicery Eatery will review the location selected by the franchisee and approve it if it meets their criteria, the franchisee is ultimately responsible for selecting the location.
Beyond Juicery Eatery does not claim to have expertise in selecting real estate sites in the franchisee's geographic area. The franchisee must provide Site Information, including demographics, traffic patterns, neighborhood character, competition, and premises characteristics. Beyond Juicery Eatery will review this information, generally completing the review within 45 days of receipt.
Beyond Juicery Eatery emphasizes that they have no obligation, duty, or liability resulting from the site selected by the franchisee or the purchase or lease of the location. They will also review the proposed lease for compliance with the Franchise Agreement and may charge a Lease Review Fee. Failure to provide Site Information or secure a site within 180 days of the Franchise Agreement can lead to termination of the agreement.
