Who is responsible for selecting the location for a Beyond Juicery Eatery Restaurant?

We will review the Site Information provided by you for the proposed site for your Restaurant, but you will be solely responsible for selecting the location for your Restaurant.
The Site Information for your proposed site will include information on the demographics of the market area, traffic patterns, a description of the character of the neighborhood, the competition in the area of the proposed site, the size, appearance, and other characteristics of the premises of the proposed site of your Restaurant and other information requested by us.
Although there is no time limit for us to review the Site Information provided by you, we will generally complete our review of the Site Information within forty-five (45) days after receipt.
We have no obligation, duty, or liability to you resulting from the site selected by you or the purchase or lease of your Location.

What This Means (2025 FDD)
According to Beyond Juicery Eatery's 2025 Franchise Disclosure Document, the franchisee is primarily responsible for selecting the location for their restaurant. However, this selection is subject to Beyond Juicery Eatery's approval. The franchisee must use Beyond Juicery Eatery’s Designated Supplier to assist in the site selection process. The franchisee needs to submit a description of the proposed site and evidence confirming favorable prospects for obtaining it, along with required Development Materials. Beyond Juicery Eatery will review the site information provided by the franchisee.
Beyond Juicery Eatery will review the location selected by the franchisee and approve it if it meets their criteria. They will also review the final lease and assign the designated area for the restaurant based on the criteria in their Operations Manual. While Beyond Juicery Eatery does not claim expertise in selecting real estate sites in the franchisee's specific geographic area, they will review the site information provided. This information includes demographics, traffic patterns, neighborhood character, competition, and the size and appearance of the premises.
Beyond Juicery Eatery has no obligation or liability resulting from the site selected by the franchisee or the purchase or lease of the location. The franchisor will review the proposed lease for the site and may charge a Lease Review Fee to determine compliance with the Franchise Agreement terms. The franchisee must select a location approved by Beyond Juicery Eatery within 120 days after the Franchise Agreement's execution. Failure to do so may result in Beyond Juicery Eatery canceling the agreement, with the initial franchise fee being non-refundable.
