When are payments other than the Development Fee due to Beyond Juicery Eatery?

- C. (1) All Payments shall be submitted to us at the address provided in Section 14 hereof, or such other address as we shall designate in writing.
- (2) Payments shall be received by us (i) upon execution hereof in the case of the Development Fee; and (ii) not more than thirty (30) days after date of invoice for all other Payments. Delinquent Payments shall bear interest from the due date until received by us at one and one-half percent (1.5%) per month or the maximum rate permitted by law, whichever is less.
- D. Developer shall not withhold or off-set any portion of any Payment due to our alleged non-performance under this Agreement or any other agreement by and between us and Developer or their respective parents, subsidiaries, or affiliates.

What This Means (2025 FDD)
According to Beyond Juicery Eatery's 2025 Franchise Disclosure Document, payments other than the Development Fee are due not more than thirty (30) days after the date of the invoice. This means that once Beyond Juicery Eatery sends an invoice for any fees or payments (excluding the initial Development Fee), the franchisee has a maximum of 30 days to remit the payment.
Beyond Juicery Eatery also specifies that any payments received late will incur interest. The interest rate applied to delinquent payments is 1.5% per month, or the maximum rate permitted by law, whichever is less. This interest accrues from the original due date until the payment is received by Beyond Juicery Eatery.
It is important to note that the franchisee is not permitted to withhold or offset any payment due to alleged non-performance by Beyond Juicery Eatery under the Development Agreement or any other agreement between the parties or their affiliates. This means that franchisees must make all required payments regardless of any disputes or claims of non-performance they may have against Beyond Juicery Eatery.
