What This Means (2025 FDD)
According to the 2025 Beyond Juicery Eatery Franchise Disclosure Document, a franchisee has a 10-day window to appoint a replacement Control Person following the resignation, termination, or death of the previous Control Person. The Control Person is the designated individual with whom Beyond Juicery Eatery will communicate and rely upon to bind the franchisee to the terms of the Franchise Agreement.
This requirement ensures that there is always a clear point of contact between Beyond Juicery Eatery and the franchisee. This facilitates efficient communication and decision-making related to the franchise operation. The franchisee authorizes the Control Person to act on their behalf in all matters pertaining to the Franchise Agreement.
If Beyond Juicery Eatery provides training for the replacement Control Person, the franchisee is responsible for covering all associated costs and expenses. These costs are based on the then-current rates for additional training, including travel expenses to attend the training. This highlights the importance of a smooth transition and the potential financial implications of training a new Control Person.
Missing the 10-day deadline to appoint a replacement Control Person could potentially lead to a breach of the Franchise Agreement, as it disrupts the established communication channel between the franchisee and Beyond Juicery Eatery. Franchisees should proactively identify and prepare potential replacement Control Persons to avoid any lapse in this critical role.
