What This Means (2025 FDD)
According to Beyond Juicery Eatery's 2025 Franchise Disclosure Document, the insurance policies that a franchisee obtains must be primary and cannot rely on any contribution from insurance policies purchased by Beyond Juicery Eatery. This means that in the event of a claim, the franchisee's insurance coverage will be the first source of funds to cover the loss, before any insurance held by the franchisor.
This requirement protects Beyond Juicery Eatery from being the first line of defense in liability claims related to a franchisee's operations. It also ensures that the franchisee takes full responsibility for managing risks associated with their business.
For a prospective Beyond Juicery Eatery franchisee, this means they must secure adequate insurance coverage to meet the franchisor's requirements and to protect their own business interests. The franchisee should carefully review the required coverage types and amounts, and ensure their policies are written as primary policies. Additionally, the franchisee must confirm that their policies include a waiver of subrogation in favor of Beyond Juicery Eatery for casualty losses, and contain no provisions that limit or reduce coverage in the event of a claim by any one or more of the insured or additional insured parties.
