uicery + Eatery" Restaurants; (viii) parking; and (ix) other data and information we receive from proprietary software that we use. You must select a location we approve within one hundred twenty (120) days after the execution of the Franchise Agreement. We may cancel the Franchise Agreement, in our sole discretion, and option if you fail to select a location acceptable to us within this time frame. In this event, your Initial Franchise Fee is non-refundable.
Timing of Restaurant Opening. We expect that single-unit franchisees will open their Restaurant within nine (9) to twelve (12) months after signing the Franchise Agreement. Factors that may influence the length of time until opening include, by way of example, your ability to obtain a lease, a building site and a site survey, acceptable financing, or zoning and building permits; your compliance with local ordinances or other community requirements; Covid-19; labor shortages; the effect of
weather conditions; materials shortages; slow delivery of materials or equipment; supply chain issues; and other factors bearing on completion of construction, decorating, purchasing, and installation of equipment, fixtures and signs. We have the discretion to approve the date of opening for the Restaurant. We may cancel the Franchise Agreement, in our sole discretion, and option if you fail to open your Restaurant within this time frame. In this event, your Initial Franchise Fee is non-refundable.
Operations Manuals. The Operations Manuals contain the proprietary and confidential standards, specifications, and procedures for the operation of your Restaurant. The Operations Manual is currently 1,267 pages long. A copy of the Tables of Contents of these manuals is attached as Exhibit K to this Disclosure Document.

What This Means (2025 FDD)
According to Beyond Juicery Eatery's 2025 Franchise Disclosure Document, the initial franchise fee is generally non-refundable. Specifically, if a prospective franchisee fails to select a location acceptable to Beyond Juicery Eatery within 120 days after signing the Franchise Agreement, Beyond Juicery Eatery may cancel the agreement, and the initial franchise fee will not be refunded. Similarly, if a franchisee fails to open their Restaurant within the expected timeframe of nine to twelve months after signing the Franchise Agreement, Beyond Juicery Eatery can cancel the agreement, and the initial franchise fee is non-refundable.
For franchisees purchasing between two and four restaurants, the initial franchise fee of $30,000 for the first restaurant is non-refundable. Franchisees developing multiple restaurants under an Area Development Agreement will also pay a Development Fee of $20,000 for each restaurant they agree to develop over five, which is also non-refundable under any circumstances.
